There's one word for the sentiments expressed by Michael Perry: "dissident". I knew he approached Catholic legal theory from a left-wing perspective, but I never knew he held such animosity toward the Magisterial teachings of the Church.
And the whole "I've never read in the Bible where Jesus said anything about homosexuality/abortion/lefty issue du jour" that he pulls in the course of that debate is pure Grade A "We are Church" hokum that one hears from the Voice of the Faithful/Call to Action crowd.
I have always been a fan of Mirror of Justice (mostly because of Prof. Garnett). But I hold that blog in much lower esteem now knowing that it includes such dissident views as Michael Perry's as valuable in "developing" Catholic legal theory.
I agree with you. Basically Perry's view of the world is that the Church us teaching a EVIL. How or why you would want to remain a Catholic I don't know.
Thanfully Perry I think is the extreme oddity on there. However I think you bring up a good point. How can you develop Catholic Legal theory if you well in are in opposition ot the CHurch on so mnay points. So I find his contribution limiting.
Also he has a very Sola Scriptoria view does he not. WHERE explicityly is this in scriptures. He seems to ignore the whole Church Tradition thing which I think is problematic for someone talking about Catholic Legal Theory
