I was over at Vox Nova and saw this comment to a post relating to if Nancy Pelosi should be removed from the Speaker ship. This viewpoint I see quite a bit coming from various areas
Now Nancy Pelosi might go to Jail?
There are of course a thousand reasons why this idea that is bantered about is a bad place to go for the Republic. However there is one that is huge. That is Justice. It seems that after a couple of years debate on this we have the following
(1)People of good will still disagree in vast numbers if Torture used in certain circumstances is wrong or illegal
(2)People of good will in vast numbers still cannot agree what is Torture and then what is valid enhanced interrogation
(3)People in the legal community are still widely at odds on the above question especially point two
(4) There appears to be a good number of people that knew what was going on a few years back and now are AGHAST ( I am shocked there is Gambling going on at Ricks)
As to my former Law Professor that is now a prime target for the "war crimes trial" posse Jay Bybee , it astonishes me that people propose he go to jail for writing a memo of all things that appears to have been written to establish order and curtail abuses. Further asto the good former LSU Law Prof I am in pretty much agreement with this Senate Testimony as to him. See Nothing Went Wrong.
Justice requires , or at least I think I did once, that a person have some idea if his acts are criminal. Statutes are often struck down because they are so broad that it could entail a huge wide area of conduct and does not really give good notice.
I find it hard to believe people like Bybee and others could be prosecuted for a "Crime" that so many people at this date can't agree on as to several basic issues.
At one time organizations like the ACLU worried about such things.
